Terms of Service

One GigaByte Network (1-GB.NET) provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of One GigaByte Network (1-GB.NET) are subject to the following terms of service:


Indemnification Policy

You agree to use all One GigaByte Network (1-GB.NET) services and facilities at your own risk. One GigaByte Network (1-GB.NET) specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall One GigaByte Network (1-GB.NET) be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold One GigaByte Network (1-GB.NET) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against One GigaByte Network (1-GB.NET), its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless One GigaByte Network (1-GB.NET) against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with One GigaByte Network (1-GB.NET)'s server.

One GigaByte Network (1-GB.NET) reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from One GigaByte Network (1-GB.NET)'s server. One GigaByte Network (1-GB.NET) shall be the sole judge of what violates this Policy.


Billing:

At this time we bill monthly and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and Domain Name registration fee is nonrefundable).

We accept Visa, Master Card, American Express, Discover Card. For webhosting plans we will setup your account without any paying. Clients are encouraged to pay by credit card as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.

30 Days Money Back Guarantee does not apply to domain names, server products and/or VPS, or custom dedicated servers.


Chargebacks: One GigaByte Network (1-GB.NET) has a no tolerance policy for abuse. If you initiate a chargeback with your card provider, we will use every means to invalidate your request. If the disputed charge is for a domain name, your domain name will be forfeited to us and may be sold to replace disputed funds.

Cancelations

You may cancel your shared or managed hosting at any time. Your service will continue through your current billing cycle. Once your current billing cycle completes your plan will be terminated and all data removed.

Dedicated Servers

If you want to cancel your dedicated server, you must give a minimum of 72 hours notice before the next billing period (usually the 1st of the month) to avoid being billed for the upcoming month. If you do give notice after the 72 hour periood, your service will be billed/charged as usual and contine through until the end of that next cycle.


Late Payments:

All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 5 days after deactivation, your account will be suspended and my be assessed a $20.00 late fee. If you will not pay for service renew in 30 days after deactivation, your account will be terminated. You will receive an email reminder 5 days till deactivation.


Acceptable Use Policy:

All services provided by One GigaByte Network (1-GB.NET) may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless One GigaByte Network (1-GB.NET) and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all One GigaByte Network (1-GB.NET) servers. This includes sites that include sexually explicit or hardcore images and/or advertising.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.


Registrants' Benefits and Responsibilities

Effective Jan 1, 2014

Domain Name Registrants' Rights:

  1. Your domain name registration and any privacy/proxy services you may use in conjunction with it must be subject to a Registration Agreement with an ICANN Accredited Registrar.
    • You are entitled to review this Registration Agreement at any time, and download a copy for your records.
  2. You are entitled to accurate and accessible information about:
    • The identity of your ICANN Accredited Registrar;
    • The identity of any proxy or privacy service provider affiliated with your Registrar;
    • Your Registrar's terms and conditions, including pricing information, applicable to domain name registrations;
    • The terms and conditions, including pricing information, applicable to any privacy services offered by your Registrar;
    • The customer support services offered by your Registrar and the privacy services provider, and how to access them;
    • How to raise concerns and resolve disputes with your Registrar and any privacy services offered by them; and
    • Instructions that explain your Registrar's processes for registering, managing, transferring, renewing, and restoring your domain name registrations, including through any proxy or privacy services made available by your Registrar.
  3. You shall not be subject to false advertising or deceptive practices by your Registrar or though any proxy or privacy services made available by your Registrar. This includes deceptive notices, hidden fees, and any practices that are illegal under the consumer protection law of your residence.

Domain Name Registrants' Responsibilities:

  1. You must comply with the terms and conditions posted by your Registrar, including applicable policies from your Registrar, the Registry and ICANN.
  2. You must review your Registrar's current Registration Agreement, along with any updates.
  3. You will assume sole responsibility for the registration and use of your domain name.
  4. You must provide accurate information for publication in directories such as WHOIS, and promptly update this to reflect any changes.
  5. You must respond to inquiries from your Registrar within fifteen (15) days, and keep your Registrar account data current. If you choose to have your domain name registration renew automatically, you must also keep your payment information current.

Pornography:

One GigaByte Network (1-GB.NET) has a zero tolerance policy on pornography that violates local, state, federal, or international law. This includes, but is not limited to, child pornography, bestiality, hard-core pornography, Hentai, and others not allowed by law. One GigaByte Network (1-GB.NET) does not seek to abridge any users rights, but we uphold any and all laws applicable to the content of sites hosted on our servers and/or network. One GigaByte Network (1-GB.NET) reserves the right to deny service without cause for sites with adult content that we deem violates local, state, or federal law.

One GigaByte Network (1-GB.NET) does mot take an active role in monitoring all sites via the web for content that does not comply with the preceding guidelines. However, One GigaByte Network (1-GB.NET) specifically retains the right to make the final decision in any matter relating to site content. Commercial Email and Spam:

Mass Mailings.   One GigaByte Network (1-GB.NET) has a ZERO TOLERANCE policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail and UCE are defined as: the sending of the same, or substantially similar, unsolicited electronic mail message, whether commercial or not, to more than one recipient. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. UCE also includes e-mail with forged headers, compromised mail server relays, and false contact information. We do not allow auto-mailer, marketing mail, or relqated mailing scripts on our services and/or network. This prohibition extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of the One GigaByte Network (1-GB.NET) servers and/or network. Violation of the above terms will result in one or all of the following:

  • A warning from One GigaByte Network (1-GB.NET) personnel by E-Mail or Telephone.
  • Removal of DNS for the advertised/originating site
  • Temporary shutdown of the website/server or a block on outgoing mail
  • Permanent disconnection of service WITHOUT REFUND.

Repeat violation of the above terms will result in the following actions:

  • Immediate disconnection of service with no re-activation
  • A $2000.00 USD fee assessed and charged to your account for violation.
  • Absolutely NO REFUNDS for ANY REASON AT ALL.
  • Additional $50 USD fee charged to your account per E-Mail sent after notification.

If your actions have caused One GigaByte Network (1-GB.NET) servers or IP Addresses to be placed on ANY blackhole lists and other mail filtering software systems used by ISP's and Web Hosting companies around the world, you will be assessed a $1000 USD charge to your account and $250 USD per hour for administrative charges incurred to remove and protect our servers and/or IP Addresses.

Banned Scripts:

The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.

  • IRC egg drops
  • Proxy servers
  • Mail bombers
  • Anonymous mailers
  • IP spoofers
  • Port scanners
  • Hivemail
  • Telnet or SSH Access Scripts
  • nph-proxy (and other scripts what operates like proxy)
  • UBB (Ultimate Bulletin Board, all versions)
  • lstmrge.cgi
  • phpShell
  • FormMail.cgi, FormMail.pl from Matt's Script Archive are not allowed.

  • LIMITATION OF LIABILITY:

    One GigaByte Network (1-GB.NET) shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from One GigaByte Network (1-GB.NET) servers going off-line or being unavailable for any reason whatsoever. Furthermore, One GigaByte Network (1-GB.NET) shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of One GigaByte Network (1-GB.NET) servers. All damages shall be limited to the immediate termination of service.


    DISCLAIMER:

    One GigaByte Network (1-GB.NET) cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by One GigaByte Network (1-GB.NET) are resold. Thus, certain equipment, routing, software, and programming used by One GigaByte Network (1-GB.NET) are not directly owned or written by One GigaByte Network (1-GB.NET). Moreover, One GigaByte Network (1-GB.NET) holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as One GigaByte Network (1-GB.NET) sees fit. FURTHERMORE, One GigaByte Network (1-GB.NET) retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
